Wrongful death is the term used when someone causes the death
of another person. It may have been caused by another person’s
actions or by their failure to act (which is called "negligence").
Since the person killed (known as the "decedent")
cannot file suit or collect damages, it is the family or representatives
of their estate that do so. The intent is to compensate family members who have suffered monetarily and
emotionally from the death. Damages can be assessed for lost wages
and benefits, loss of companionship, emotional pain and suffering
caused by the trauma and, in some cases, punitive damages.

Time Limitations
In every state there is a time limit (known
as a "statute of limitations") regarding the filing

In Iowa, the law gives a plaintiff two years from the date they knew,
or should have known of the injury or death, with a maximum of
six years from the date of occurrence.
